I agree with Olson/Boies objection to intervene. The case is simply about the facts and not the theatre surrounding it. While I don't want to get my hopes up, I think this case has a better chance of succeeding than others in the past. Good luck to the plaintiffs!

Great post, Chris. Any chance you'll be getting your hands on the ADF case management statement? I've looked around for it, but couldn't find it.

With a Dec 14th trial date, it's likely to mess up christmas plans as well. Poor Judge Walker's clerks!

Thanks again, Chris!

So, for the average Joe with no formal background in law (i.e., me), what does this all mean? I can follow the argument, but why wouldn't they want the intervenors to join the suit? Is it really only because the plaintiffs wish to keep absolute control over how the case is argued? Maybe I'm being naïve and/or paranoid, but as a married gay man in California, I don't want LGBT rights to be marooned up sh*t creek for the foreseeable future because of some farsighted right wing plot to bring the case before an unfavorable U.S. Supreme Court. Does Ted Olson really care about our civil rights?

I'd be very grateful to those of you who are more knowledgeable about law than I if you could explain what you, in your professional opinion, think T.O. is doing.

Looking through Olson's reasons for why the court should deny intervention of the coalition, I have to agree with him. I wouldn't want to work with a party that was publicly against what I was doing. But his reasons against intervention of San Francisco seem to have less merit. I predict the city being allowed in.
